Right of Revocation for Consumers

Customers who are consumers have the following right to revoke the contract:

Right of Revocation

Without stating any reasons, you have the right to cancel your contract within 14 days. The withdrawal period of fourteen days begins from the day on which you or a third party named by you and who is not the carrier, has taken possession of the goods. To exercise your right of withdrawal, you must inform us in in a clearly written declaration (e.g. a letter sent by mail, fax or e-mail) about your decision to revoke this contract. Our address is:

You may use the attached sample cancellation form, but this is not a requirement. In order to comply with the withdrawal period, we must receive the statement that you are exercising the right of withdrawal before the withdrawal period expires.

Consequences of Cancellation

If you withdraw from this contract, we must repay you all payments that we have received from you, including the delivery costs (excluding any additional costs resulting from the fact that you have chosen a type of delivery other than the reasonable, standard delivery offered by us), without delay and at the latest within fourteen days from the day on which we received the notification of your withdrawal from this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no event shall you be charged for this repayment. We may refuse repayment until we have received the returned goods or until you have provided proof that you have dispatched the goods to us, whichever occurs earlier. You must return or hand over the goods to us without delay and certainly no later than fourteen days from the date on which you notified us of the cancellation of this contract. The deadline is met if you send the goods off before the period of fourteen days expires. The consumer must pay for the immediate costs of the return shipment if the delivered

goods correspond to the ordered goods. On receipt of the returned goods, we will check the returned items (condition, properties and functioning) for loss of value. If the loss of value is due to incorrect handling of the goods whilst they were in your position, then you must bear these costs.

Exceptions to Rights of Cancellation

Unless otherwise agreed, the right of withdrawal does not apply to the following contracts, with the result that you cannot revoke your declaration of intent. The right of cancellation does not apply to:

  • contracts for the supply of goods which are not prefabricated and for the production of which an individual selection or specification by the consumer is required, or which are clearly tailored to the personal needs of the consumer,

  • contracts where the consumer has expressly requested the Abacus Resale to visit him in order to carry out urgent repair or maintenance work; this does not apply to other services provided during the visit if the consumer has not expressly requested these, or to goods supplied during the visit which are not necessarily required as spare parts for the maintenance or repair.

Unless otherwise agreed, the right of withdrawal may expire prematurely in the case of the following contracts, with the result that you would lose any right of withdrawal that initially existed:

  • contracts for the delivery of sealed goods which are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery,

  • contracts for the delivery of goods should they have been inseparably mixed with other goods after delivery due to their nature.

Recommendations in regard to Returns (non-binding)

These procedures are not pre-requisites for the effective exercise of the withdrawal. They are non-binding recommendations of the seller.

Customers are requested to notify the seller of the return before returning the goods so that the returned products can be allocated as quickly as possible. The contact address is:

Customers are requested to return the goods to the Seller using an insured delivery service and to retain proof of shipment. Unless the immediate costs of the return shipment are to be carried by the customer, the Seller will reimburse customers in advance for the postage costs upon request.

Customers are requested to avoid the damage or contamination of the goods during transport. If possible, the goods should be returned to the seller in their original packaging with all accessories. If the original packaging is no longer in the buyer's possession, other suitable packaging should be used to ensure adequate protection against damage in transit and to avoid any claims for damages due to inadequate packaging.
